Terms and Conditions for Ely Boat Chandlers Ltd
Use of our website and the sale and purchase of goods from the website are governed by our terms and conditions as set out below. "We" or "Our" means Ely Boat Chandlers Ltd. "You" or "your" means the person accessing, using or ordering from our website over the Internet, or by telephone (any form of mail order).

  
1. Ely Boat Chandlers Ltd.
Goods are supplied by Ely Boat Chandlers Ltd directly to you and the contract of sale then exists between you and Ely Boat Chandlers Ltd. These terms and conditions cover all sales made through this website.

2. Prices, description and availability of goods
Prices are subject to change without notice and all goods are sold subject to availability. Where goods are temporarily out of stock we will contact you so that you may choose between having it shipped when it is back in stock, selecting an alternative product or cancelling the order.
 
Whilst we take the utmost care to ensure the product descriptions, pictures, information and prices are accurate we do not accept liability for any inaccuracies, errors or omissions. Colours may vary slightly from those shown on the website due to the limitations of Internet technology.

We reserve the right to vary prices between our website (www.elyboatchandlers.com) and the physical shop (21 Waterside, Ely, CB7 4AU).
Orders are accepted at our sole discretion and we maintain the right to decline orders without giving an explanation.

Ely Boat Chandlers Ltd reserves the right to cancel an internet (distance selling order) up to the point (time) of delivery (to the customers designated address). It should be noted that a particular example of this would be if an item has been mis-priced by (or on) the website and cannot be supplied for the stated price on the order. We would contact you to discuss this issue prior to accepting the order by processing (releasing) the Sagepay payment (at the time of order the Sagepay payment is only deferred and not released, we release it manually once the order has been reviewed by our staff).


3. Payment methods
We take payment for online orders in two ways (decided by the customer at the time of order), over the telephone using the stores card machine, or automated online using SagePay. Please note that we will not take any money from your account (Credit or Debit card) without contacting you first to confirm the order. Please see our "Ordering and Delivery" page for further details of how to order from us and pay for your chosen goods.
 
It is the responsibility of the purchaser to ensure that the payment/s process without problem and that the item being ordered is correct for its intended use. If in doubt enquire by email or phone we are here to help!.
 
 
4. Sales tax
Value Added Tax (VAT) is calculated on shipping destination. When applicable it is included in the price for orders shipped to destinations within the European Union (EU). For orders shipped to destinations outside the EU the price excludes VAT but orders may be subject to local sales tax or import duty. These are not included in our prices and customers remain liable for payment of these taxes or duties on or following delivery. Please note that EBC Ltd do not ship goods outside the UK as normal practice, each case is considered at the discretion of Ely Boat Chandlers Ltd.

5. Delivery arrangements
Your shopping basket displays the goods you wish to purchase, some with an indication of the delivery timescale. We will notify you if your goods are not able to be despatched within this timescale, e.g. some Ëśmade to order" goods may take longer. The cost for delivery may be stated in the shopping basket, if not then we will contact you upon receipt of your order (which is not binding until we have contacted you to discuss your order, clarified and discussed delivery arrangements and taken payment). Any delivery times and costs quoted are estimates, based on availability and normal delivery time. Please note that there may be some products that we do not ship to certain destinations.

 
Please note that Ely Boat Chandlers Ltd retain the right to decline an order on grounds of delivery concerns.

Royal Mail:
  • We will aim to place orders received by 2pm in the post the same working day, however this is not always possible.
  • Order received after 2pm will usually be placed in the post the following working day.
  • All postal deliveries are based upon standard post office services and may be subject to associated national delays and disruptions.
 
Courier delivery:
  • If we deliver direct to you from one of our wholesalers the timescale and company may vary . Upon order confirmation and taking payment we (Ely Boat Chandlers Ltd) will clarify the delivery method and timescale. Our aim is to ensure you receive your goods in the most cost effective convenient manner possible.
  • Goods being despatched from Ely Boat Chandlers ltd retail premises use the Business Post next day delivery service (overnight is achieved virtually all the time however it is not guaranteed), or ParcelForce 24 or 48.
  • Delivery by courier may be anytime between the hours of 9am to 6pm.
  • We will put your phone number on the delivery ticket, however the driver is not obliged in any way to call you to advise of a delivery time.
  • The delivery vans Business post or ParcelForce use do not have tail lifts.
  • Each and every delivery by Business post will require a signature from the person receiving the goods.
  • It is the customers responsibility to ensure that somebody is available to receive and sign for the goods upon delivery.
  • Any damage found upon delivery must be reported to Ely Boat Chandlers within 24 hours of receipt of goods.
  • All recorded and courier deliveries MUST be signed for. It is the purchaser's responsibility to ensure that someone will be available at the delivery address to sign for the goods. If no-one is available and the goods are returned to us the purchaser will be responsible for outgoing and return carriage charges. Any refund made will be less these amounts. Delivery charges for non- defective returns are not refundable.
  • Delivery days means normal working days ( Monday to Friday, excluding bank holiday, Christmas / New years eve). We cannot accept responsibility for delays caused by Royal Mail and / or other courier service. If there is an issue about missing goods or late arrival of goods send us an email or call us and we will chase it up with the carriers.
  • Delivery to Northern Ireland and the Scottish Highlands and Islands may incur greater delivery costs. We will contact customers in these regions of the UK with delivery cost figures.
  • Our website automatically calculates a delivery cost and applies it to an order. We reserve the right to amend the delivery cost should circumstances dictate the goods cannot be delivered for that stated cost. We would contact you (the customer) to discuss the alternative delivery options prior to accepting your order (releasing your Sagepay payment, or taking payment over the telephone).
6. Cooling off period and cancellation / returns
If you are unhappy with the goods purchased you may cancel your order and return the goods to the Merchant within 14 calendar days from receipt of the goods. In order to provide notice of your wish to cancel we (Ely Boat Chandlers Ltd) must receive written notification within 14 calendar days from the date you received the goods, notification by telephone will not suffice. Written notification must include all relevant details of the purchase so that we can process your request. You will receive a refund within 30 days of cancellation (if accepted).It is your responsibility to take "reasonable" care of the goods before returning them, and they must be returned in a state where they can be resold.

In order for goods to be resold they need to meet the following criteria:
  • All packaging undamaged and in "as new" condition and complete
  • All instructions, paperwork and parts must be complete and undamaged.
  • The goods must be undamaged and in "as new" condition. Goods that have been used and as such cannot be sold in "as new" condition do not meet this criteria. Please see below:
We will not accept return of (subject to Warranty or Guarantee considerations):
  • Goods made or cut (e.g rope) to the customer's personal specifications
  • The item is a special purchase item for EBC ltd (non-stock)
  • Outboard motors that have been oiled and run
  • Outboard motors which have had their warranty registered with Honda UK.
  • Goods that have been opened and used (hence cannot be sold as new)
  • We do not accept returns of tins of paint or any consumable or maintenance product (e.g fibreglass resin or a tube of sealant).
It is vital that you enclose a covering letter with the return detailing your name, full address, order number and reason for return (please also specify whether you require an exchange or refund). We recommend that you use Recorded Delivery, as proof of shipping is not proof of receipt. 
 
Unless the goods are defective, damaged or not as specified on your order acknowledgement, you are responsible for the cost of returning goods to the merchant. We recommend that you use Recorded and insured delivery, as proof of shipping is not proof of receipt, and postal damage on returning goods is the responsibility of the sender. If however the goods are faulty (were faulty upon despatch at time of sale) then the postage costs will be refunded.
 
Goods are guaranteed or Warranted (if appropriate) by the wholesaler or manufacturer (where appropriate) for varying periods from date of purchase (check the site and product packaging for details, if in doubt please ask we are here to help!), for defects in manufacture or materials. We will replace, or have repaired, defective goods if required as agreed with the customer but reserve the right to give a refund/part refund in line with current legislation.

If the packaging is sealed and unopened at delivery and you then discover that the product is faulty or damaged please email or call us immediately. Product returns due to defective manufacture or possible damage in transit must be authorized by ourselves.

All third party copyright, product names and titles, trademarks, brand names, on this website are acknowledged. This website is protected by Copyright and the Copyright, Trademarks, logos and Intellectual Property rights for the content of this website are the property of Ely Boat Chandlers Ltd.  ALL RIGHTS RESERVED. Any framing of this website is prohibited. Any use, printing or copying of materials on this website, other than in the course of browsing, selecting products and ordering from us, is strictly prohibited.

 
10. Privacy
This privacy statement applies solely to information collected through this website.

Information Collection and Use . We are committed to protecting your privacy. We use the information we collect about you to process orders. We will only use the information that we collect about you lawfully in accordance with the Data Protection Act 1998. We will not sell, share, or rent this information to others other than as disclosed in this statement.

During the registration or ordering process we collect some or all of the following information:
  • Your name and address
  • Your contact telephone numbers (to enable us to contact you in the event of a query)
  • Your e-mail address
  • Card / Bank details are only taken on the SagePay gateway site during the final stages of making a purchase. This is a third party secure website, no banking details are taken or held by Ely Boat Chandlers ltd when you pay via this method.
  • If you pay via a telephone order then your card / bank details are typed straight into the card machine, no record of your card details are retained by Ely Boat Chandlers Ltd other than the merchant half of the PDQ receipt.
We will confirm your personal details on our acknowledgement of order, and you will have full opportunity to amend your details, order or delivery address when we call to take payment and arrange delivery. If you have registered you may check, amend or remove your personal details by logging in. If you are not registered you can check, amend or remove your personal details by e-mailing sales@elyboatchandlers.co.uk or writing to us. By registering or ordering through our website you consent to the collection and processing of your personal details by us.

Contests & Surveys
From time-to-time our website invites information from users via surveys or contests. Participation in these surveys or contests is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information (such as name and address), and demographic information (such as postcode, age level). Contact information will be used to notify the winners and award prizes and may be used to send you marketing or promotional materials where indicated. Survey information will be used for purposes of monitoring or improving the use and satisfaction of this website (e.g is a FAQ useful or not, does a product description need to be more detailed etc).

Log Files
We use IP addresses to analyse trends, administer the website, track user's movement, and gather broad demographic information. IP addresses are not linked to personally identifiable information.

11. Legal issues
The contract will be governed by the laws of England and Wales and you agree to submit to the jurisdiction of the English courts. These terms and conditions do not affect your statutory rights as a consumer.

12. Notification of Changes to policy
If we change our Terms and conditions, Privacy policy or Security policy, we will post notification of these changes on our website so you are aware of them. Should we decide to use personally identifiable information in a manner different from that stated at the time it was collected, we would notify you by e-mail and request your agreement to the changes. We will use information in accordance with the privacy policy under which the information was collected.
